Sony wins $800k in copyright case against TikToker

A landmark ruling emphasizes the importance of respecting music copyrights.

In a striking victory for copyright law, Sony Music has successfully secured over $800,000 in damages following a high-profile copyright infringement case. This legal battle centred on a TikTok user’s unauthorized use of a Sony-protected song, spotlighting the music industry’s ongoing fight against copyright violations.

The case unfolded when Sony Music, a titan in the entertainment industry, issued a stern copyright takedown notice against the track “90mph” by Arizona-based artist Trefuego, whose real name is Dantreal Daevon Clark-Rainbolt. Sony’s legal action stemmed from allegations that Trefuego had blatantly lifted parts of the 1986 track “Reflections” by Japanese composer Toshifumi Hinata, known professionally as Hinata, without seeking permission or providing due credit.

Sony Music’s lawsuit accused Trefuego of “flagrant and deliberate infringement,” arguing that he had unlawfully appropriated Hinata’s musical composition and sound recording for his own gain. According to the lawsuit, Trefuego’s actions not only breached United States Copyright Laws but also caused significant harm to the market for Hinata’s original works by misleadingly suggesting his endorsement of the use of “Reflections” in “90mph.”

In response to Sony’s allegations, a judge last year found Clark-Rainbolt guilty of copyright infringement, a decision that set the stage for this week’s consequential financial judgment. The court ordered the rapper to compensate Sony Music with $802,997, a sum that includes approximately $700,000 in ill-gotten profits from streaming platforms and an additional $100,000 for Sony’s licensing fees.

The judgment, as articulated by US District Judge Mark T Pittman, aims to serve as a stark reminder of the legal responsibilities and potential repercussions associated with using copyrighted materials without permission. “The court hopes this case will serve as a $802,997.23 lesson for the defendant in carefully selecting the materials included in his raps,” Judge Pittman noted, underscoring the importance of respecting copyright laws in the creation and distribution of music.

This case marks a significant moment in the ongoing dialogue around copyright enforcement in the digital age, particularly within the rapidly evolving landscape of social media and content creation platforms like TikTok.
