Senator Reynolds concludes testimony amid controversies over leaks and text message deletion

On August 9, 2024, Liberal Senator Linda Reynolds took the witness stand for the final day of cross-examination in her defamation trial against her former staffer, Brittany Higgins. The trial, held in the Western Australian Supreme Court, centres on Reynolds’ claims that Higgins’ social media posts damaged her reputation.

Reynolds’ lawyer, Martin Bennett, is expected to re-examine her after the cross-examination concludes. Reynolds must finish her testimony today to return to Parliament House for the upcoming sitting week.

Reynolds admitted to deleting text messages exchanged with Bruce Lehrmann’s then-barrister, Steven Whybrow, as part of routine “cyber hygiene.” These messages, sent during Lehrmann’s criminal trial, included one where Whybrow thanked Reynolds for providing contact details and encouraged her to “hang in there.”

Young argued that Reynolds’ assertion of not being aware of Higgins’ alleged rape by April 1, 2019, was “not credible” and that allegations of a conspiracy between Higgins and her husband, David Sharaz, to damage Reynolds’ reputation were unfounded.

Higgins settled a personal injury claim against the government in December 2022 for $2.445 million related to the alleged rape by Lehrmann in Parliament House. Lehrmann has consistently denied the allegations and faced a criminal trial in October 2022, which was aborted due to juror misconduct. A second trial was not pursued due to concerns for Higgins’ mental health.

In April, a federal court found on the balance of probabilities that Lehrmann raped Higgins during a separate defamation trial.
