Islamabad High Court mandates Adiala Jail to ensure ex-PM Imran Khan meets his lawyers, amidst rising political tensions

In a significant development for the political landscape of Pakistan, the Islamabad High Court (IHC) has ordered the Adiala jail administration to present former Prime Minister Imran Khan before the court today at 3 PM. This order comes during ongoing contempt of court proceedings against the jail superintendent, who has faced criticism for denying Khan’s lawyers access to their client.

Justice Sardar Ejaz Ishaq Khan led the proceedings, asserting the necessity of allowing Khan to meet with his legal team. “Bring the PTI founder; he will have a meeting with his lawyers,” the judge instructed during the hearing. The court is pushing for accountability from the jail authorities, who have kept Khan incarcerated for over a year due to multiple legal cases, with the New Toshakhana reference being the only case currently pending.

Imran Khan’s legal troubles intensified following his arrest alongside his wife, Bushra Bibi, shortly after their acquittal in a separate legal matter related to the iddat case, which revolved around allegations of an un-Islamic marriage contract. The PTI founder had previously appeared before the Supreme Court via video link in connection with amendments to the National Accountability Bureau (NAB) laws in May.

In a show of international support, over 60 members of the United States House of Representatives recently penned a letter to President Joe Biden, urging him to prioritise human rights issues in US-Pakistan relations. During the hearing, Justice Ishaq expressed frustration over the lack of access Khan’s lawyers have had to him since October 3. “The court does not accept the security threats […] the lawyers were not allowed to meet; this is contempt of the court,” he stated. The judge demanded that the Adiala jail superintendent provide a comprehensive report from the Interior Ministry outlining any alleged threats that justified the restrictions on meetings.

The situation took a more complicated turn when the state counsel informed the court that the Punjab government had imposed a ban on meetings within the jail due to security concerns. Justice Ishaq was quick to respond, questioning the legitimacy of such a ban on lawyers. “Is there a ban on lawyers meeting him? If the Punjab government has prohibited the meeting of the lawyers, it would have committed contempt of court,” he remarked, underscoring the gravity of the situation.

In light of these events, the court also summoned the joint secretary of the Interior Ministry to present relevant records and issued a notice to the attorney general’s office to assist with the proceedings.
